When we had the assessment the HP asked Stephen to transfer from his wheelchair into a rigid chair. Surely this must be discriminatory? I can understand from a wheelchair to an examination table, or let me see you walk please but from a wheelchair to a rigid plastic chair? Where else would you get away with asking someone to do that?

Did he transfer to the chair? He had the right to refuse if doing so would have caused him unreasonable physical or mental distress.

No he didn't Gordon but she's noted that he declined to transfer. It would have increased his pain significantly but i'm still quite angry about the fact that she asked. You wouldn't get away with it anywhere else so why is it ok for them to do it?

Not specifically but I don't think it is an unreasonable request, lots of claimants attend in wheelchairs even though they can still walk.

Quick update!
Got a letter this morning informing us that DWP have changed their decision, awarded hubby enhanced for both until 2021 and cancelled his appeal!
Glad that's over with, just gearing up for my battle with ATOS over the falsified report.
I concentrated a little too much on the lies at first, now I've looked at the report without that in mind it's absolutely shocking how incorrect/shoddy the work is. I'm having great fun picking it apart.
I've spoken to MIND who were very supportive, Select Committee for Work and Pensions who pointed me to some great info and a top firm of Barristers dealing with benefits issues!
I just have to find a solicitor and persuade them all to work for free for the 'greater good!' ( I love Hot Fuzz!
