Appeal Tribunal for PIP success . was created by pahatouridis
Tribunal hearing for PIP yesterday was a success story as my wife was placed in the enhanced rate for living and mobility. She was on standard (10 points ) for living and enhanced for mobility (12 points).
The best money I ever paid are to be a member of the site....I have to thank the site for the advice given to us for the bureaucratic minefield laid in front of the disable claimants by DWP in order to make them fail based in wording details and other misleading and dishonest tricks emplyed by HP of ATOS and DM of DWP.
I had all papers towards DWP and Tribunal prepared after spending weeks in preparation and a lot of medical papers from the consultants looking after my wife .To cut it short the judge was a very polite man who turned up as we entered towards the representative of DWP and told her ,,,have you seen this audiograph from her specialist. She answered yes and the the judge continued saying OK you got 2 point more for using hearing aid and total score of 12 that means you are in enhanced living allowance now ,do you want to continue ??I said as her representative ...No Sir thank you very much we do not want to waste everyone's time any more and we went out in less than 5 minutes in total and the clerk brought the decision after 10 minutes. Now we wait in the next payment of PIP to collect the money for the difference between standard and enhanced amounts backdated .I would like to ask also that now that she is in enhanced living allowance for PIP IS THAT GOING TO HAVE ANY INFLUENCE on ESA (INCOME BASED )PAYMENTS TOO?? The reason I ask that is that she claims ESA for both as a couple ,I claim as her carer the CA .She is receiving for both of us "£149 and myself as a care around £62 weekly. Now with enhanced living allowance for PIP will that will make us automatically entitled to premium for severe disability in higher rate of £124.90 instead the £62.45 for lower rate??Thank you for ALL.

Congratulations to you and your wife on the appeal win, well done.
It usually takes the DWP 5-8 weeks to process a Tribunal result, I would ring them next week to make sure that they have received the Decision Notice.
If your wife is not in the Support Group then her Enhanced Daily Living award entitles her to the Enhanced Disability Premium, about £15 per week.
I assume you have a PIP or DLA award and it is this that is enabling payment of the Severe Disability Premium currently. You cannot receive the higher rate as you are claiming Carers Allowance against her PIP.

These are the rates for 2017 and new for 2018 regarding ESA payments and for a couple it is :
both over 18 114.85 114.85
Premiums
enhanced disability
single 15.90 16.40
couple 22.85 23.55
severe disability
single 62.45 64.30
couple (lower rate) 62.45 64.30
couple (higher rate) 124.90 128.60
carer 34.95
My query is that lower and higher rate as it seems that are connected to PIP awards for living allowance standard or enhanced.

The Sever Disability Premium is not based on the rate only whether a Daily Living award is in place.
The requirement for the couples rate is that both claimants receive a qualifying benefit AND that CA is not in payment against either of the PIP/DLA awards.
