A bit of good news (sort of).

I've just recived a letter from the upper tribunal and from what I can gather they agree with me that there was error of law.


I really could do with someone having a look at this letter but this forum doesn't allow attachments.

Can I upload it somewhere and post a link to it on here?

It hasn't actually got to the UTT, a District Judge has obviously decided that the FTT Decision was unsafe and referred your appeal back to the FTT for a new hearing.

Oh ok

Good job I uploaded it.

Does that mean I could still request the upper tribunal to look at it if it fails again?

Also a lot has happened since my last appeal.
For example I'm now on PIP, my medication has changed and got stronger and I'm now under a psychiatrist.

Should I send a letter with all these changes in to the tribunal?

The new hearing, as was the case for the last one, can only consider your health and limitations as they were on the day of the Decision that originally appealed any change since then such as your change in medication, cannot be considered.

If you receive another adverse condition from this new hearing and you can show that there was an Error of Law in the making of the new Decision then you can appeal to the UTT again.
