Well i got refused again on mr and i am really annoyed the reasons are insulting and have now filled out form for tribunal, i am absolutely disgusted with the outcome i have read about people beeing awarded with the same as what my daughter is going threw i just don't get how the decision makers make there decision when i have 3 pieces of evidence from cahms doctors and school and still refused me with insults .

Hi Foz,

I am sorry to hear that you need to appeal to the tribunal. Please don't give up. Success rate at the tribunal is good, and the tribunal understand that DWP don't always make correct decisions.
After you have lodged the appeal, possibly a month or so later, a set of appeal papers will arrive. (Appeal bundle) Have a good look at all these papers and there may be more explanation as to why DWP has made the decision it did. If you haven't done so already, and assuming that your daughter's care needs are similar to when you claimed DLA, keep a diary fir a week or two and note down all the care needs you have provided This could include, but is not limited to, reassurance, physical care, eg toileting, feeding, supervising, bathing or prompting to do these activities. If you have friends with children of the same age ask them about how much care they give to their children- this could serve as a good comparison. What exactly was the evidence from the school - was this purely about learning difficulties or did it deal with behavioral difficulties? Does your daughter have any special needs involvement. If these things are not covered already, it might be worthvwhile getting a further statement from school. The teacher will also be able to make a comparison between your daughter's needs and those of non-disabled children.
Make sure you have all these things done, and any extra evidence sent into the tribunal well before the date.

It is now a waiting game.
