hi i had my appeal 1st april got letter today and was refused by tribunal the tribunal was awfull

Hello zoski85,

I am sorry to hear that the tribunal was just a bad experience for you.

You do have a right to ask to for a 'Statement of Reasons' and also a copy of proceedings. The statement should tell you why they decided what they decided. If you believe that they have made an error in law then you have a right to request the Upper Tribunal look at the decision which the tribunal came to.

thank you so much for your reply. i was appauled at some of the comments made ine for example was if i went to my childs parents evening i told them no i do it over the phone thier reply was what so for last 3 year youve not seen your childs teacher it was the way it was said that upset me tellling me that thats very bad but awared no point.

can i ask are you suppose to walk through pain or do activitys during pain

im either in pain during or laid up for days the following day

Hi Zoski85,

To be able to do something you have to be able to ‘reliably’ – this means you have to be able to do it-

Safely – in a fashion that is unlikely to cause harm to themselves or to another person.
To a necessary and appropriate standard – given the nature of the activity.
Repeatedly – as often as is reasonably required.
In a timely manner – in a reasonable time period.

Clearly if the result of doing something is that you are unable to repeat it due to pain you do not meet the criteria for being able to do it reliably.

thank you very much i cannot walk very far due to pain during or after then the next might not beable to do it at all due to pain
