A cynical thought I'm afraid. Many of us pay £s extra for signed-for postal service to be sure DWP cannot turn round and claim they never got our form/letter etc. How come DWP can attempt to deprive someone of benefit on the grounds of the claimant not replying to a letter that DWP has no proof they ever received??? Let them too pay out for signed-for, or else take our word for it, fair should be fair!

Hi Denby,
I'm not sure about benefits, but court documents always used to be sent signed for. As you acknowledge this is expensive. So some while ago, all official documents went out simply first or second class. Court rules, and tribunal rules ascwell as individual regulations etc nowadays tend to have a clause that says that letters sent eg first class will be deemed to be delivered the next working day after posting. This is a presumption, backed by the law. However if you can produce cogent evidence to the contrary the presumption will not be met.
Don't worry I am not trying to defend DWP, but they do get through an awful lot of post each day let alone year. If they genuinely had to prove postage AND receipt by claimant of everything, the benefits system would literally grind to a halt, and it would cost millions. So, I agree that the current system is not ideal, but it sort if works.
I have no idea whether LEAP letters are actually sent out. The main problem could be if the computer thinks they have, then it is very hard to prove otherwise. There might even be a huge pile in a nail room somewhere hidden under the volume of paperwork not yet sent. Who knows!!!

Thanks, I couldn't agree more about the practicalities and public money, it is the imbalance in belief that the other party is telling the truth that tbh riles me, because it is nigh impossible to prove the negative...and if claimants could trust DWP not to lose so much paperwork, they would not need to spend out.

Hi Gary my wife rang up to the dwp over a week ago and she asked the person on the phone that I wanted to be put in touch with the leap review Team for a review,they said they would send me a review form to fill in plus a copy of the leap letter they say I received in January 2020 which of course I did not.I have not received a copy of the letter yet

Did you ask for it to be noted that you did not receive a copy of the LEAP letter which they say was sent in January 2020.

Hi Gary I don't think we did ask for it to be noted,I will of course let you know if and when I receive a copy of the so called leap letter.Do you know what sort of time frame it may be to receive a copy or is it a case of how long is a piece of string.As always Gary thank you for your time in replying to my posts.
