Leap review concerns

just had a chat with lovely ?? man from dwp

so there answers are -
They cannot look at the decision made in 2016 because that was made by a tribunal
even though it was made BEFORE the new ruling.

They cannot look at the decision made in 2018, because that was AFTER the new ruling, so the decision maker 'will' ??????????????? have already considered the new ruling.

plus of course it is now too late to ask for that decision to be looked at again.

how b***dy convenient.

I did go through with him why i could not ask for MR at the time, and also the reasons the mobility was given 0.
I told him to my mind the new rulings were NOT considered on that occasion

Anyway he is going off to talk about it to someone? and said he will call me back
but i dont expect any change .

He was himself very pleasant and clear.
He said they have been told to ONLY look at decisions made from 28.11.16 ( MH ruling made)
and 26.6.18 (date from which MH and RJ to be considered by decision makers)

Do you think the DWP have a whole department on how to wriggle out of everything?
and to devise new ways of scaring people and confusing them?

the 'admin exercises' man rang back and said he could send my request on the 2018 decision, to the reconsideration team, and he listened to why i had not asked before and then read back what he had written.

waiting game now, i guess, although i am not really expecting anything to come of it, but at least he tried
