Confused about ESA CB changing area and housing el

Gary if I am on CB ESA can I loose it due to me applying for universal credit? My prognosis is for another two years although I need to move houses because I experience a lot of bullying from my neighbours (also because of my disability and benefits) and it's simply dangerous for me to be here. I have to leave. So basically any change to my accommodation now (as universal credit is everywhere) can result in me loosing my benefits and having to undergo assesment again? If I move within the same borough will they need me to apply for UC as well? I am asking because I live in a housing association flat and I think council treats this differently. What do I have to specifically do to ensure I am in a support group on UC as well? I don't know if gp will issue indefinite sick note but I know that I need to move out from here. What should I do? It has already stopped me once from moving out because I started being affraid of the benefits. Previously to this I stayed in supported housing and although they were dealing with benefits side of things they have not move me to universal credit even when I was asking them.

Hi organic

You do need to get help from a Welfare Rights Organisation to give you accurate advice as they can take all your circumstances into consideration.

From your post you state that 'I was awarded LCWRA and I am in the Support Group', when someone tells me they are in the support group then that tells me they are in receipt of legacy ESA whereas if I am told they receive LCWRA that tells me they are in receipt of UC/NS ESA.

You say you are about to move, are you moving to a different local authority? do you already receive HE or HB? These are some of the questions the adviser will ask you.

Sometimes when moving from ESA and you provide a fit note, then you may be referred for a new Work Capability Assessment, if the claimants condition has deteriorated then it may be a good idea to get a new WCA under UC.

Unfortunately we cannot give you specific advice, you will need to contact your local Welfare Rights Organisation; You can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies. advicelocal.uk

What I can tell you is that you will not lose your CB ESA but it will be taken into consideration £ for £ when assessing your UC.

If you claim HB and move within the same local authority then you do not have to claim UC you just need to notify your local authority of a change of circumstances. Housing association tenants and tenants in the private sector are treated no differently when moving within a local authority.

Sorry but we cannot tell you what to do as we do not have all your circumstances, this is why you need to seek help from a Welfare Rights Organisation.

This is something you have no control of, you will stay in the support group until you are reassessed and either, found fit for work or placed in WRAG/LCW group.

Gary, they have just extended my Contibution Based ESA for two years a month ago, so are you saying that I certainly will have another health assesmemt when I move the borough and apply for Universal Credit as I need housing element? Is that a certain? From what Citizens Advice told me I should be able to still be getting contribution based ESA.
