Hi I first off thanks to everyone who manages this website I have found it a great help over the years. This is my first ever post on here but have been reading the forum and news for years now. I am my partner's appointee and have been for a number of years she suffers with multiple mental illnesses PTSD, psychotic disorder and mild to moderate cognitive impairment being the main three but also some other things to many to list. In 2018 when I heard about the leap review I wrote to the DWP straight away asking if my partners claim would be reviewed because I believed my partner fit this criteria 1 f. Cannot follow the route of a familiar journey without another person, an assistance dog or an orientation aid. 12 points.) or at least this one Cannot follow the route of an unfamiliar journey without another person, assistance dog or orientation aid. 10 points. So finally in December 2019 they sent the leap review decision letter saying we have reviewed it but no award has been made. Now I always meant to challenge this decision but at this time my partner had stopped taking her anti psychotic medication and became very seriously ill which had to be dealt with so I knew I had 13 months to ask for an MR with good reason for being late so thought I will deal with that when my partner is better. Then in February 2020 Coronavirus hit and I was identified as extremely vulnerable because I have lung disease and various other illnesses myself so not only was my partner very ill but now I had the most worrying year of my life ever but there was some good news during this period my partner was assessed and awarded enhanced for daily living and mobility. So what happened was I dropped the ball on asking for an MR on the leap review it timed out I forgot with everything else what was going off I was so angry with myself it was 17 months later after the decision letter. So I wrote to the DWP asking for one anyway outlining my reasons why it was so late of course they refused it so I wrote to my MP who then asked the DWP to please allow the MR again the DWP refused but said I could ask the court to see if they would accept my appeal without an MR it is down to a judges decision. So I tried that route the court refused saying there is no jurisdiction without an MR so I asked if a judge could look at it again but again the decision came back just yesterday saying the same thing so now there is nowhere to go I don't think there is any legal reason to take it to the upper tribunal. I felt compelled to post this today which is why I have spent the money on subscribing in hope in finding someone who fits the criteria in the latest news update because if it was the case my partner had just had that leap review decision letter she would have fit the criteria perfectly. My only hope now is that the whole leap review process gets shown up for what it is and the DWP have to do it again lawfully.

Hi Michael

It sounds as if you have done everything you could have done to ask them to look at it under the leap review. As you say, I think your only hope is waiting for a challenge to the entire Leap Review process which is ongoing.
