Lasting Power of Attorney

Hi,
I have recently been diagnosed with Young Onset Dementia and we have applied for a LPA for my daughter to act on my behalf (I know it takes about 6 months to be registered). Will this LPA allow my daughter to act on my behalf for my ESA and PiP claims (have been receiving both since 2014) or do we still have to apply for my daughter to get Appointee status as well? I've tried to search for previous posts covering this topic and am confused if the LPA will be accepted or if we need both (sorry for the confusion).

Hi Natasha

I'm sorry about your diagnosis. This is not my area of expertise, and I tried to research it, but it wasn't entirely clear from the government guidance. It does say as an LPA your daughter can manage the benefits - but you want to know that she can 'speak' if necessary, on your behalf about your condition. I assume she would be able to - but I think it would be worth giving the LPA people a ring or sending an email to see if this will suffice.

Natasha, if you notify the DWP you have power of attorney, they will ask for a copy of it and will make you his appointee. they have done this for my husband who also has early onset dementia.

Hi all,
Just wanted to give a quick update on the LPA query in case it is helpful to anyone else on this forum. Our LPA was finally registered with the OPG. Following Anne's kind advice we phoned the PiP line to inform them of the LPA. Thankfully we managed to get through after a 20min wait, however the call handler had no experience of dealing with LPA's and so was unsure of what action needed to be taken to register it on the system! Initially he asked us to post the original LPA in (which given the DWP's record of things getting "lost" in the mail, we were very reluctant to do!). We informed the call handler that he could view the LPA online on the OPG website by us providing him with a code that we were able to set up - he was completely unaware of this and we had to provide instructions to him which seemed bizarre given both the DWP and OPG use the "gov.uk" web address. Nevertheless, after a call lasting around a further 20mins the call handler confirmed that he had found the document and that everything was fine. I had my doubts and requested that written confirmation be sent to us confirming that the LPA was registered on the PiP claim.
5 days later and we log into the bank account on the normal day on which we usually receive the PiP payment to discover that the usual payment has not been made. Another phone call to the PiP helpline. Again, thankfully, we were connected after a 15min wait . This time the call handler understood the LPA system however, it took her a further 40mins to try to determine what the previous call handler had done and why the payment hadn't gone through. In the end she said payment had been suspended because of the LPA (which sounds extremely odd) and the previous call handler had not registered the LPA correctly on the system, but she had successfully registered it onto the system. She said she had lifted the payment suspension and a payment will be made in the next 3-5 days and then should, in theory, return to the usual payment schedule (we shall wait and see).
So, all in all, what should be an easy enough process to register an LPA seems to depend on the knowledge and skill of the call handler!
Of course we were told that the call handler can only register the LPA for our PiP claim and we will have to phone the ESA line separately to go through the whole process again to register the LPA with them!
Thank you once again to BIS and Anne for your help and advice on this topic and hope that perhaps this may help anyone else with LPA queries!

Hi Natasha

Thank you for giving us an update. I hope the money does arrive in your daughter's account as promised. It is so annoying that you have to register the LPA again (ridiculous). There should be an internal system for it being logged against all benefits.

I hope it's soon sorted for you.
