PIP Thank You was created by mistake
Hi Everyone

My wife was on ESA for many years. Early this year I told DWP that there had been a change in circumstances and that I wanted to update them so they had up to date info, as I already knew they said we would need to apply for PIP.

I filled the form in with as much information as I could and sent them numerous pages of Specialist/Psychiatrists/Memory Clinics reports and diagnosis and after about 26 weeks we got the decision. They advised that my wife qualified for the enhanced rate on care and mobility, they said they had all the evidence needed on the paperwork I sent to make the decision without anything further, no phone call and no face to face.

I want to thank you for all the hard work you do and all the documentation you produce on your site, this helped me give them what they needed to know in full and to send them all the documents they required.

I wonder if you could just give me your advice on one last thing. The information included with the decision papers said "You need to inform us if you go outside the Uk for more than 13 weeks in the year", which we defo wont be doing but I read something else online that said tell them if you leave the country at all. Could you tell me please which is correct, do I need to tell them if we go away for a week and when they talk about "the year" do they mean April - April or Jan -Dec.

Many Thanks once Again

Mick

Hi mistake

That is really terrific news, well done and congratulations. I am tagging my reply so that the back office also get to read your encouraging post.

In answer to your question, it would depend on what benefits you were claiming.

It is 13 weeks for PIP and 4 weeks for ESA. The day they leave and the day they return should not be counted. See

www.gov.uk/claim-benefits-abroad/disability-benefits

If the claimant is only receiving Contribution Based ESA then the claim is usually suspended if the claimant exceeds the limits, if they are only receiving Income Related ESA then the claim will be closed and as a new claim would be required, this may require a claim for Universal Credit.

The law on this is black and white on this subject, so if their absence extends to more than 28 days even if it was originally planned for less, then, their ESA stops.

If you go abroad, you can continue to get Universal Credit for one month.
You must:

* be eligible for Universal Credit when you’re going abroad
* remain eligible for it while you’re abroad
* tell your work coach that you’re going

Thank you Gary. My wife only gets PIP no other benefits, so if we go away for 10 days and this is the only holiday out of this country in the year, do I have to tell them we are going

Hi Mistake

You honestly don't have to tell them. Your wife has recently had an award - it's not as if she's waiting for an assessment. If she was I'd advise you to tell them. They honestly won't care.
