Hi everyone and thanks for the good job you continue to do.
Have a quick query that has bothered me of late.
Client is a 30 year old lady with two young children and on UC.
She is getting UC for looking 3 children of her mother who passed away
4 years ago. All 3 of children are disabled and in receipt of DLA MR.
Because of this, she is not getting benefit for her own children in the UC.
Has been at the job centre and was told that there is nothing they can do
about it.
My query is that is this how the benefit cap works and is there a way this
can be adjusted? She needs to get benefits for her own children despite
her caring for the siblings.

Thank you for the question, something does not sound correct.
Your client will not be hit with the benefit cap, as children receive DLA middle care. Does the client receive Carers Allowance?
Your client will need to seek help from their local Welfare Rights Organisation; advicelocal.uk they will be able to take all relevant information into consideration, are Social Services involved? who has legal custody of the children? What are the ages of all the children?
There are many other questions that need to asked to get accurate advice.
