ESA not approved. How long for decision on MR? was created by Elizabeth
Hi my husband has not been approved at all at his assessment for ESA despite him having PIP. I know these are not linked. We have asked for an MR. How long does it normally take for this to happen and him informed of the decision?

I'm sorry, but we can't say these days. It could be as little as six weeks, but it could run into several months.

Replied by Elizabeth on topic ESA not approved. How long for decision on MR?
After putting in for MR the DWP has called to say that this is not needed and to go straight to appeal! Is this right? Seems they have already made up their minds not to award ESA? Really frustrating as the appeal falls out if the original timelines. I have submitted the appeal on line explaining the delay. It is also my understanding that ESA payments should resume whilst going through the appeal process, is the correct and if so, is this automatically reinstated?

Providing he was found Fit for Work and not because of an administrative problem; failing to return the ESA50, or failing to attend an assessment, then he will be entitled to the Assessment rate while he waits for a Tribunal hearing.
It should be automatic but I would still write the DWP asking for payments to be reinstated.
