STILL WAITING FOR ESA WCA 10 MONTHS AFTER CLAIM STARTED was created by Jim
Dear Sirs ,
I claimed new style ESA on January 5th 2024 and my claim was accepted . I have been receiving the assessment
phase payment for nearly 10months and still have to submit fit notes from my doctor .
I contacted DWP in July and was sent a ESA50
which i completed and was told to return to DWP Belfast (not the health assessors providers ) . I made a complaint in September
about the delays and was contacted by a DWP manager who told me there had been a mix up but i should get another ESA50 soon from the assessment providers . It is now nearly October and I have approximately 12 weeks left until my 365days of new style ESA ends . I have still not received an ESA50 from the health assessment provider and haven't received a WCA or been allocated to any group .
I have obviously missed out on the extra payment for persons allocated to the support group and have not received any support
from being in the WRA group . The DWP manager said that any extra payments would be backdated but this can only occur if I am assessed . What can i do now . I am finding the whole situation very stressful and it certainly isn't helping my health conditions .

Yes, you are in a difficult situation and I do not know a quick answer as you have already made a complaint, the option I some times use is to get your MP involved depending on how proactive your MP is, they maybe able to get your claim moved on.
There has been a bit of a shake up with the assessments and claimants should be seen earlier especially new claims.

Hi Gary ,
Could you tell me what my rights are . Do i have a right to a WCA before the 365 days is up , or can i just be thrown off without being assessed .
If i have rights then i do not need to involve my MP as i will take the issue to a tribunal .

Hi Jim
Answer to your question is no you do not have a right to a WCA.
I believe your claim would stop and you would go on to UC, once you have a decision on your WCA, you will either stay on UC or you will be placed in the support group and the decision backdated.
You cannot appeal the decision as no decion has been made, which s why it may be advisable to get your MP involved.
