Hello,
I am still suffering with a lot of pain every day with my sciatica nerve pain. My fit note is about to end soon, so I will be going to my GP, to get another Fit note. ( I am self-employed) The last one they gave me, my GP ticked the box, "You are not fit to work "
there is another box that says "you may be fit for work, taking in the following advice.
I am going to apply for ESA, so what box does my GP need to tick, if they tick the same one I have already, not fit for work, would that allow me to apply for ESA, or does the other box need to be ticked?

Hi ZenZen,

A Fit Note stating " you maybe fit for work, taking in the following advice " is sufficient for a new ESA claim.

Hi David,
Thanks for the reply, so if they were to tick the box "unfit for work' does that mean u couldn't apply for the ESA?

Hi ZenZen,

You could apply for New Style ESA which is the only ESA currently available as Income Based ESA has been replaced with Universal Credit. New Style ESA is contributions based.

Yes it would be new style ESA I would apply for. What I'm trying to find out is, with the fit note, does it matter what box is ticked to be able to apply for ESA?
you mentioned the box ("you maybe fit for work, taking in the following advice ") but at the moment, the fit note I have is a ("unfit for work") does it have to be the box you mentioned? or can it be either one?

Hi ZenZen,

Definitely " unfit for work " and usually " you maybe fit for work, taking in the following advice ". I suppose if the GP said in " the following advice " that your health condition was trivial to the extent that you could almost do a full day's work then ESA could be refused. But this is a hypothetical situation and there are dozens of hypothetical situations as per the patient and the GP.
