Hi
Im confused as to my protected benefits. UC are making deductions for my 15hrs a week employment (£702 take home). This is ultimatley resulting in my being £1674 per yr worse off??
Previously i recieved £481 twice a month ESA support group. £240.50.
This month i recieved £902 in UC. £222.69 per wk.
Surely my tranistional protection should mean im no worse off? What can i do about this please. I cannot cope with another mandatory consideration!!!
Im also aware i have paid NI for a few years and feel like i should be on New Style ESA but i feel scared of applying in case things get worse and i end up in more and more paperwork and appeals.. will it even help me??
My experience of benefits calculators is that they are confusing, and i often get diferent results..
I live alone so no support with this.. i have bipolar and ptsd and do get in a state with this because i feel theyre out to get me..

Hi Sassy,
You need to get a full calculation of your transitional protection. You can request this officially from the DWP and the charity CPAG provide an online facility for doing this. Go to this link and complete the details and cut and poste the letter onto your UC Journal and send the message under the option A Payment.

Hi Dave,
They have just provided details of what i was on, what i am entiled to on uc and pointed out the difference of £307 is my TP.
But i knew this as its on my statements. I feel the letter i posted from cpag was asking for more than this.. but my brain is fried.
My big question is ' if my benefit award is protected how are they deducting money for my wages, leaving me worse off under managed migration'?
I am really struggling with the journal thing because they seem to bounce me around and around.

Hi Sassy,
If the DWP have made a mistake then you are going to need someone from a Benefits Advice organisation such as Citizens Advice to help you challenge them. According to Rightsnet the DWP are making a lot of mistakes in their Managed Migration calculations. The majority they say are in the claimant's favour but obviously some will be negative to the claimant.
There is one rule that you should be made aware of and that is regarding the UC AET. AET stands for the Administrative Earnings Threshold. It refers to an amount of earnings in a UC Month ( called an Assessment Period ). The AET is now £892 per monthly Assessment Period. There is a rule called Regulation 56 which means that if your earnings go below this amount for 3 consecutive months following a first month when the earnings were above the AET then you lose all Transitional Protection. This even applies if your employers accountant paid you twice in your monthly assessment period or if you had a tax rebate or backdated holiday pay. The rule applies to carers and to those in the LCWRA/Support group.
