WCA and tribunal advise was created by Arrietty
Hi, I had an WCA and it did not go in my favour, so I asked what happens next and someone from the DWP decided to put in an MR without me asking,
I rung multiple times and asked for it to be halted as I didn't have chance to give evidence and I did ask for it to be out in when it was, I was told it takes that long and they ask you if you want to submit any new evidence so I will be fine, one week later the MR came back saying they haven't changed there mind!

So now I'm left with no option to go to a tribunal,

Do I say what's happened and reason why there was no new evidence?

Can I go through the assessment and give my reasons why I don't agree with what was said?

The medical letters, I gave when I filled out the form for WCA assessment, will they still be kept or do I resubmit them?

Can I give statements from my carer, my employer and family members as evidence?

Any advice will be much appreciated thanks

Hi. Arrietty

Welcome to the forum.

You might want to have a look at the following FAQ which explains where everything is; www.benefitsandwork.co.uk/guides-for-claimants/faq/forum.

You now have to appeal the decision, the first thing you need to do is complete a submission, you may need to seek advice from your local Welfare Rights Organisation, they will be able to help you.

Have you got a copy of the assessors report called a UC85, you do need a copy of this to see how the DWP made their decision.

I would resubmit any evidence that will help your cause, yes use statements from your carer, employer and family members, make sure you give their name and address on each statement, remember their statements needs to be relevant to your condition, if they give support, explain what support they give and why, the why part is the important part.

Don't forget to use our guide to help you with your appeal; www.benefitsandwork.co.uk/help-for-claimants/esa1
