I have not heard that there are exemptions for nearing State Pension age.

So it would mean a couple of months on UC if upon receive a migration letter and apply close to 3 month return/apply date.

One would have thought they would exempt those retiring in a year or sooner. Seems pointless, but if thats what the rules are.

If you are single then that is correct. But there are different rules for mixed age couples.

Hi Clearwater,

In the news section a while ago(can't remember under which topic) someone posted that you become exempt from migrating to UC when within 6 months of reaching state retirement age. I also remember they added it was a complex issue and hard to get information on this set of circumstances but I seem to recall a link was posted.
I was interested to read this as I am going to be applying for my state pension in September this year. It would be so much easier to not have to migrate to UC, come off housing benefit only to have to reapply again all within possibly months of each other.

Fingers crossed for us both!

Hi Gaddy

How would this work .... as you are not forced to take your State Pension and you could defer taking it. So if you were to be exempt from Migration then you could stay on Legacy Benefits such as ESA indefinitely?
