Don't worry this is completely normal....if you read the other members posts. Everyone has to accept a claimant commitment with New Style ESA. You can make a request to have a phone interview instead.

Hi David,

ESA called me last week and are sending my claim to a decision maker about my NI credits. I had to attend a meeting with a work coach yesterday and they are sending out a UC50 and making me go though a wca despite knowing there's been a possible technical error with my claim. Is there anything I can do? I was so upset yesterday I had a panic attack on the call and I ended up having to call nhs24

It is a good thing that your ESA claim is going to be examined by a more senior person than a Benefits processor.
I suggest that you wait until the Decision Maker has given their verdict. Also if necessary make use of the offer of personal assistance from your local Citizens Advice.

Hi David.

I received a call from ESA. They said they're giving me the credits. However they said I would have been due for reassessment in Jan 2020 and it will be up to UC to see whether they're going to give me lcwra. Am I wrong in thinking once I joined my partner's claim I would not have been assessed anyway because they don't assess partners and at that point I held support group status and was entitled to a credits only claim and should have been transferred as lcwra. My welfare rights office only replied to my email saying we need to wait to see what UC say. I wondered what you thought because I believe you've given me the most solid and correct advice so far.

Hi Blissfulblues

I am glad that the Decision Maker has decided in your favour and you have been awarded the National Insurance Credits. This should be for the complete period from the joining of the ESA claims together in 2020 until the new UC claim. So now your Support Group status would be protected throughout that period and UC should recognise this and place you in the LCWRA group.
You are correct in that partners to ESA claims are not assessed.
If you have any difficulties with the UC Decision Maker let me know and we can escalate the issue to UC management.
