Tribunal-I Love You!

I've just been for my Tribunal Hearing and my appeal was upheld. I had a folder full of information from B&W and the medical report I had gone over with a fine toothed comb, and I DIDN'T EVEN HAVE TO OPEN IT! The hearing lasted about ten minutes and then they stopped it and upheld the appeal. Thanks to B&W for all the information on the site. I couldn't have understood any of the DWP gobledeegook without your most incisive documents. Six months of hell at an end at last. Bob Marley once told me to stand up for my rights, and I always will, so thanks to Bob as well. Don't give up!

Ahhhhhh, straight from the heart. Really pleased for you, well done.
Would you mind if I asked you a wee quicky....
At the beginning of your tribunal, when they give you the oportunity to say whatever, did you start of with bringing your dispute with the medical report to the fore, then advise them how you feel you meet the criteria.
Mines coming up shortly and that is my intention at the start. I have provided a lot of paperwork, and further medical evidence, but I would be wanting to know what the tribunal want me to further answer. So, do you think it would be advisable to ask them what their view is on what I have said re my medical report.
Just really looking advice on how to start off in the best possible way, only myself and my husband no rep.
Can you point me to what you would feel would be a good way to open.
For e.g.
My husband. "We believe my wife entitled to....... rate.
He then quote the legislation and regulation that applys.
Him again, my wife has provided evidence to support.
Him again, my wife has now presented herself to tribunal for any further info the members feel they still need and has not already been addressed in written submissions.
Am I on the right tract or not in your opinion. Your advice would be much appreciated.

Kathy, It was over so quickly I couldn't get my breath. The Trib Doctor asked me a few questions based on the report. I told him I couldn't understand why the ATOS Doctor had written certain things and that it misrepresented me. He questioned me a bit more and then the lawyer asked me a couple of things in a really friendly way, and actually, we had a converation about things that had nothing to do with the case, and my representative was laughing in the background! After all the worry I had, it wasn't stressful at all, but the rep said I could have had a Tribunal that wasn't so friendly, so I had good luck on the day. Incidentally, I think my case was quite cut and dried in some ways, and they probably didn't want to waste any time on it. I should never have failed the WCA. Anyway, it sounds as if you are quite well prepared and that's the best thing, but it is nerve racking. Good luck.

And I forgot to say, I had already written to them and told them I should have been on Support Group rate and telling them which descriptors I thought I should have got points for, so they already had my letter. They get to the point pretty quickly and start on the medical report. You have to say why you think it's unreliable.
