Hi
An update on my claim for DLA I have been awarded the lower care rate for practical care, nothing was mentioned regarding personal care.
Nothing awarded for mobility which does present problms often.
I have requested a copy of the medical examiners report so I have a record if I need to chalenge it.
My award runs until March 2011 so it looks like I will have to go through all this again.
Without B/W site I dont belive I would have any award made. I don't know if I should lodge another appeal as I don't know if I am up to it.
My letter states that because they had reversed their decision it never went to the appeal board, is this normal practise?
Any way I will be renewing my membership with B/W as I feel sure I will need it in the future.

Hi Lottie
It is normal procedure for an appeal to lapse after it has been changed in your favour on reconsideration. However you are still entitled to appeal if you are still dissatisfied with the outcome.

The appeal should only lapse if the appellant receives everything they were asking for on a reconsideration, by way of a just and proper award.
If the appellant does not receive what they expected, the appeal should continue and the papers passed to the Tribunal Service for a hearing to be arranged.
