If your rep cannot attend, you could ask for another adjournment but it will not be guaranteed that the TS will grant an adjournment, as in the situation as described it is not always a good enough reason. It may depend entirely onthe circumstances of your case.

If you can't read (all) the EMP's report, you can ask for a typed transcript and the Tribunal Service are duty bound to agree to your request. It is a well-established principle that all written evidence must be completely legible to the parties involved with the appeal. If the TS continue to refuse the request, you could seek an adjournment on the basis of a primary source of evidence being illegible and therefore inadmissable in its current form. Inform the TS that you are prepared to seek an adjournment in these circumstances.

well i just got back from my appeal,i lost and they also took away my lower rate care. it was a nightmare experience.45 minutes of interrogation.the doctor kept on asking about mobilty when it was the care component that was being looked at ,comments made that i look as if i eat more than the usual cereal that is my food they commented on my hair [which looks like a bag of straw]they thought i coloured it .i said i didnt .then the doctor said i seemed to be intelligent so i should be able to look after my affairs.i didnt know you had to be daft to suffer from anxiety and depression..i do not know what to do next.maybe ask for a report from them and see just what was thought.more stress

Poor you! No you don't have to be daft, look at Stephen Fry! I have an honours degree and I suffer from depression and anxiety too.

It sounds like you have been treated very badly to me.

Can you get yourself a new welfare advisor?

Rachel
