Finacial Redress for Maladministration

Hello

Has anyone tried to claim 'Finacial Redress for Maladministration', due to a Decision Maker making a wrong decision?This could be down to pure incompetence, or relying totally on an Atos Medical recommendation, rather than including a review of a customer's medical notes.

Can it be done? Any thoughts?

Incorrect and/or adverse decision maker's decisions are not normally subject to the rules of maladministration, as the appeals process seeks to remedy any injustice that a claimant has suffered as a consequence of a wrong decision.

Maladministration usually refers to administrative procedures that have not been properly followed by the DWP and other government departments, whereas DM decisions are subject to a judicial procedure. There are however potential exceptions to the rule, so if you believe that you have suffered from maladministration, for example, failure to implement the decision of an appeal tribunal not subject to UT appeal, there may be grounds to seek redress for maladministration as defined in the document entitled Financial Redress for Injustice Resulting from Maladministration.
