New or Old ESA50? was created by WmWallace
Hi,
I recievied an ESA50 through the post on Wed 16 March 2011. I know the new regs do not come into force until the 28 March 2011.
I am presently in the support group. My question is do I get dealt with under the old regs or the new ones?
All help appreciated.

It depends on what version of the ESA50 you have received.
The new one has a date of 03/11, this is printed on the bottom of page 1, where it asks for your name an address.
If it is the old ESA50 then they must assess you using the current/old criteria.

Hi George,
You might want to hang fire with completing it. Our guides to the new form are due out on 28 march, the date the new test becomes law.
Check the date you need to return the forms by, it's usually six weeks from the date it was sent out.

Thanks, thats what i had intended to do, wait until you had a chance to get your eyes on the new regs

i would also be questioning if they should have sent that before the date of the new regulations. My understanding is if you fill in the old form date 10/10 then you are assessed under the old rules. I recently made a claim...knowing that the new rules were coming, i contated the jobcentre to make sure my claim was being dealt with...I received my form 5 days ago and filled it in immediately, it was the old form.
Fortunately I havr claimed previously, failed my medical on 0 points and won my appeal with 24.so this time the information on the form was very detailed - I am hoping that theres enough to avoid the medical....we shall see, but thanks to this site i will make sure i cover everything in detail in the medical...good luck george
