Hi all,
Just had a call back from DWP, nice lady agreed with my points raised and would send me a pre change of reg form, a 10/10 one. So I would ring up and challence any new reg forms issued before 28 March 2011.
This will enable you to get on record your concerns with this procedure, and the way they are using it.

That's very impressive indeed.
I've just checked the regs and they do indeed apply to people who claim before 28 March but who have their assessment after that date unless they were sent the old questionnaire.
So, legally they can send the new questionnaire out now - which is why it's on the DirectGov website.
But well done for asserting yourself so effectively - clearly the law is not a strong point at Jobcentre Plus.

I have had to re-apply for ESA due to mistakes made by DWP. Both times - the second just yesterday - before the 28th of March.
If I understand you clearly, when the time comes, can we insist on the last questionnaire?

George got his changed, but legally the DWP did not have to do this.
So if the need arises, try and get it changed, but if they refuse, you would have to complete the new form.
