ESA Appeal Problem was created by injuredcyclist
Hi,
I would be really grateful if anyone could help at all please?
I've got a head injury. It's possible it will take another year to recover from, althoug there is no medical fixed time for recovery.
I've just been put in to WRAg,which is completel inappropriate for me but I'm unsure whether to appeal as stress has a huge adverse affect on my recovery.
Am I correct in believing that WRIs are put on hold if I appeal the ESA decision?
If that is the case I could appeal which, due to the current backlog, would buy me about 4 months time to hopefully recover enough to attend aWRI.
Currently I cant go out of the house unaccompanied and I think I have a reasonable case for appeal but am not sure if I can deal with the stress compared to the WRAG option.

I am not aware of any mechanism which defers WFIs while you are appealing, however, there are changes to the system which are currently being implemented, that may have a similar effect
First the back end of the process is being changed, which has resulted in the effective termination of all current WFIs awaiting the start of the new system in a couple of months.
Secondly the new system is supposed to take into account the Return to Work Date more effectively so that a claimant is only asked to participate shortly before they are fit to work. How realistic this measure will be is open to debate, but it may make it more likely that you can defer an interview to a time when you are more able to attend.
Hope this helps.

If you look on the other forum board,Discussions, there is a topic, "appeal no work program interview" it has a yellow triangle with an exclamation mark in it. I think from reading these threads that you are correct in your assumption. Check it out yourself.

Adding to my prior post full title of the post is appealling WRAG,etc etc. Also I think you will need to be appealing to be put in the support group.
Also depending on whether your ESA is contribution based, or income related, and how long your review date is.You could also be exempt.
As I said read the posts, and clck on the relevant links, see what you think,
cheers

Thanks for reminding me Bro58, I re-read the thread and WFIs will be suspended under the new system, while a claimant is appealing to be placed in the Support Group rather than the WRAG.

Gordon and bro58 - thank you for this,it 's very helpful.
I'm on contribution based.
Do you know if you can find out/guess what your review date is likely to be?
