About to write my husbands appeal letter was created by Loopylou862
I am about to start typing up my husbands appeal letter, he was awarded HRM & HRC by tribunal back in 2007 and after a home medical 2 weeks ago had it taken away,my friends sister is a senior physio for the NHS for 22years and has looked over his report and written a section by section rebuttle of it for example he did not examine my husbands back or ask him to show him how he did things infact he just sat in the chair and asked questions. She thinks i should submit this with my appeal? can any one advise if they think this is a good idea please . Many thanks

was the medical for normal review or had someone contacted the DWP and said your husband is not sick ?

also a report from a physio is imo a very good idea has she carried out an examination of your husband or just read the reprot and seen mistakes in how its been wrote ?

we had the letter that a lot of people are getting 'evidence shadow of doubt etc' but they can not provide any evidence. apparently the format of the letter is being changed. she looked over his report and gave her proffesional opinion of the things he had written without any form of examination, infact he got out of his seat once to stroke the lower from part of his legs and asked him to squeeze his hand.

It is entirely up to you what evidence you supply to the Tribunal, however, you need to be aware that the Tribunal will make its own decision as to the weight they will assign it.

Rebutting the medical evidence can be important, but a decision in your favour is going to be the result of you showing that your husband meets the criteria and therefore deserves it.

I also suspect that the exmaination procedures used by ATOS are significantly different from those used by a Senior Physiotherapist.

thanks you gordon, my point would have been that he did not use any examination procedures at all to come to his conclusions, also as I said my husbands original claim was awarded by the tribual.
i just am exasperated that he could write things without doing any examinations or asking my husband in depth about his problems with everyday living.
