Nothing on this board constitutes legal advice - always consult a professional about specific problems

I am going by what realfaithuk has written.
We have always said that there will be variation in the transfer, whether this particular transfer means that others receiving IS will be moved in the short term, I have no idea. For example, realfaithuk says that she was previously exempyed from medicals, maybe this is why they have been selected now.

We have had so much confusing and contradictory information from the DWP about the migration that I have given up trying to work out who they're going to migrate when.
Anyway, to the problem. Realfaith - have I understood right that you're concerned that you no longer have access to a CPN or psychiatrist to back up your claim, but you have very unwell as is shown by the fact that you need carers.
I would echo Gordon's advice to try to get some help to fill in the form. Is there a mental health advocate locally who could help you? Or a CAB bureau?
Let's get down to basics. You don't get ESA for the diagnosis. You get it because you can/can't do particular things. So, with such help as you can get, you need to work your way through the form, answering the questions honestly and adding any extra notes you think would help to explain things.
Meanwhile, try to get hold of your GP. If you can't get hold of him at the moment, don't panic. The DWP is likely to send him a form to fill in and he can fill that in without seeing you. If you can't get hold of him, leave a note with his receptionist saying you need to see him and that you want to discuss the form before he fills it in, but if he doesn't talk with you about it, don't panic. If you're struggling so much you need carers, he'll know that, surely?
Then there may be a medical. This may not go ahead depending on what your GP says, but let's assume it does.
Read our guides first, then take someone with you. Ideally, take an advocate, but a friend, relative or carer would help. Just someone to make sure that you don't feel pressurised.
I hope this helps, but if you want to ask more, please do.

Thanks For your reply Gordon....To be honest, having understood that IS to ESA would have been completed last or later..and especially given my illness and age...your reply now resurrects my worst fears. God those people at the DWP must be laughing all the way at this psychological warfare they are inflicting on us
How they sleep at night..and all those ATOS accomplices also..is beyond me?...I'm really hoping that Karma kicks in soon..and that what goes around..comes around.
Never one to wish harm to others..my patience and that of thousands of us is wearing extremely thin..I am totally distraught and depressed at what tack this Gov't has taken...far from protecting the sick and vulnerable...their policies 'stink' of human rights abuse/disability discrimination on a scale not seen for generations...more words fail me......

Hi all
Just updating you on the progress of my quest to be issued the correct ESA50 ie 10/09 & not the 03/11 as per my earlier posts.
Nothing in the post today either from Atos or local JC+ so having finally been able to compose a letter detailing all that has happened since mid March 2011 to Darra Singh, Chief Exec of DWP & copied it to my MP asking him to get involved - hopefully it'll be sorted before th date I had to agree with Atos for the medical next month.
On another topic I've received today the Employment Tribunal Judgement in which the Judge totaly trashed my claims for unfair dismissal & disability discrimination & has ordered me to pay my ex employer nearly 5k in costs & has stated I am not being asked to pay more as both me & my husband are on benefits! This without seeing the documents I had taken, as required, to show income, savings & outgoings. Zero savings, not much income & the same outgoings we had from when I was working.
My ex employer had retained from the outset of my claims, 18 months ago, the services of a top barrister specialising in employment law as well as their own in-house specalist employemen law solicitor & as my trade union had completely c...ed up in its handling of my claims I ended up having to present my own case in the tribunal against a slick & clever barrister whilst all along having to deal with the effects of my ME & depression, none of which the Judge made any kind of even minor allowances.
Apparently, I can appeal the judgement!! Whoopee doo- I have neither the means nor the health to do it, so not only has my ex employer dismissed me unfairly having already failed to make reasonable adjustments as required under the DDA I am now having to pay them for the privilege of it having broken employment law & the DDA, sacking me & my daring to take it to an ET & try to best a top barrister.
I'm trying not to let this or the problems with JC+ & Atos get me down as I know that most of B & W members live with far worse health conditions & personal circumstances than do I & in the grand scheme of life there are people all over the world who have far, far worse lives than mine but I do feel that natural justice is hiding away right now.
Thank you to all the members who have posted your support for me, it's very much appreciated.
Anyway, onwards & upwards - wishing you all as enjoyable a long weekend as possible, especially the mods.
Best wishes
maggie

Having received nothing in the post from JC+, Atos & now the DWP I have now sent an email to Darra Singh, ccd to my MP, asking DS to pull his finger out & sort this mess out once & for all.
I don't think anyone who hasn't had first hand experience of claiming benefits could believe the bullying, ignorance & oft times dishonesty of DWP & Atos staffs that claimants are having to put up with.
Anyway, to those of you who are still up - sweet dreams when you do manage to get to sleep.
