Hi yes I challenged their findings as I was informed by a disability advisor that allot of the answers are preformed drop down answers. I also added a letter from my GP.

Many thanks for that info. In the likely event that I get refused I will appeal in the way that your advisor did for you. I dont have anyone advising me so its simply help from this site that I am using.

I have already supplied GP supporting info so I suppose I will not need to send that again.

Hi Bill

I have also asked for a reconsideration as I only got LRC. The DM said I could walk further than 50 yards, but slowly. The reality is that I can only walk 40 yards without severe discomfort. :(

Also they said I could do all the other things but with difficulty. When I know when I try and do all of them, probably 2 days a week I spend the rest of the week in severe pain. :(

But in the hobbies and interests part they said I did need physical help from another person to take part in them. Yet in the main form for example they said I can get into/out of a bath on my own, dry myself amd get dressed afterwards. Then in the form for washing and getting dried and dressed the DM said I can do it but with difficulty. Therefore they said I can do it on my own, they didn't mention I would be in severe pain the rest of the day after doing it though which I would be. :lol:

That is confusing me I don't know about you. Talk about being annoying :angry: how can the DM say when I go swimming I need help but at home I don't? Can anyone answer that?

Definitely go ahead and appeal the decision, as I initially applied for DLA in October 2009 and they stated that I was absolutely fine and thus refused me the benefit. In my situation they had requested a report from my GP that did not say much about my illnesses, and even the Welfare Officer said that the GP report made my case more difficult.

I did not listen to anyone, as I was (and still am) extremely ill and barely managed to move out of the house more than once a week. I made sure that I appealled against the decision, and in the meantime collated as much evidence as I possibly could on my illnesses and how they affected me each and every day. I was actually better informed than the Welfare people and used the guides from this site to help me be prepared.

In the end, I eventually received a Tribunal date in October 2010, which was adjourned as the Tribunal members wanted more evidence. By November 2010 they got the evidence they needed, and in December 2010 I received a letter stating that I should have received DLA at the highest rates for Care and Mobility. All payments were backdated to October 2009 and paid to me from January 2011.

At the end of the day I was patient and prepared, and I won. So do not lose hope, and if you are honestly very ill and know you deserve to be receiving something, appeal the decision. Do not let other people make you lose hope. You just have to be patient, that's all.

Hi Korky,

Wow, thats some confusion and like you, I would be lost.

You say about your walking and pain and I had a similar experience last year.

My Orthopaedic Consultant wrote that I suffered ''severe'' pain on walking and that it would ''persist'' but the Tribunal said that as he hadnt noted how far I could walk before the ''severe'' pain, it was fair for them to assume that ''I could walk 200mtrs''.

I argued that point but lost my appeal and to this day I cannot understand how they think, even with the help available on this site.

Hi, The way i have read items on this site it is Discomfort not pain that is taken into consideration and that any walking whilst in severe discomfort is not taken into account. Jim1 a moderator on this site actually posted a piece about this if you search the site you should come across it (i think it was late last year) Best Wishes
