Hi I am have a query re backdated ESA. Basically I have been claiming ESA when my sick pay ran out and as I had a fit note which my GP had authorised "may be able to return to work" and my employer could not accommodate the proviso, then my role was made redundant on capability grounds.
Meanwhile as I had not issued the DWP with a current medical certificate from the GP (I supplied them with the above fit note but it had no end date), they suspended my claim. I have since left my job and am on jobseekers.However I have put in a new claim for ESA to cover the backdated payments as my original claim was stopped due to me signing on for JSA! This is despite being told 2 days beforehand by ESA that they would continue my original claim pending medical evidence!
I am not sure whether to appeal the original decision or whether to wait and see what they do with the new claim?

You don'y mention any timescales in your post, so it is not possible to give a specific answer, however ESA can be backdated up to three months from the date of the claim, providing it is supported by FIt notes for the period.

Thanks it's within the last 3 months, I am applying retrospectively for the last 6 weeks.

Just a note to update I got 6 weeks backdated ESA after I requested a call back from a supervisor. I sent my form in recorded delivery and everything went smoothly.
