IB to ESA was created by MUK
I currently get DLA mobility high rate and IB with IS for mortage interest paid to lender.

I got the benifit change letter then nothing more till a letter informing my ESA50 was due back in less then 2 weeks.

I phoned up explaing that I had not recived the ESA50 and they said they would send a new ESA50 with a new return date.

Sound ok ... but I got the replacement ESA50 form mid July and a letter on Saturday stopping my IB and closing my ESA claim as the ESA50 was not returned by the old return date.

Again I phoned up and expalined all told to put in an appeal about IB being stopped and another appeal against my ESA claim being closed.
I also contacted my MP who is writing to them. I have rushed the ESA50 which I've only had 2 weeks to get it in via recorded post today.

No idea if I will get my IB restarted or have to wait till ESA claim is processed.

Worried sick I will not have any money coming in. Not had anything about my IS claim so far.

Unfortunately, it seems to be a trend at the moment for the DWP to make one statement on the telephone, and to do the opposite in fact.

Appealing these decisions is the only way forward and the involvement of your MP should help to prioritise the DWP's response.

I suspect that your IS claim will also be terminated as the underlying claim, your IB, has ceased.

I have no idea how long this appeal process may take, so it may be worth you making a new claim for ESA, however, as your previous claim was terminated due to an "apparent" technical failure, I am not sure whether you would be eligible to payments until you had attended a WCA medical.

It might also be of value to seek assistance from the CAB or a Welfare Rights officer in the hope that they can resolve the situation quickly.

Hi,MUK,

This is truely awful, yet another example of the shambles that ATOS are.

You are right to involve your M.P., did you not receive "The Phonecall" that they are supposed to make after your initial migration letter, and supposedly before you get your ESA50.

In hindsight you should have backed up your phone contact with them,with a follow up letter, (keeping copy), I do keep banging on about this on the forum.

That of course is of no help to you now.

I am sure that one of the Mods will provide you with more in depth advice.

I record all my phone calls using turecall and I block withheld numbers so I think the DWP may have tried to call (so they say) but I've not recived any calls from them about ESA.

I have had calls from mortgages team sorting out other proplems with IS claim in the past.

If they say that they called you, ask for proof, was record made of the call.

Where did they get your number, had you given it to them, had you made a request for them not to phone you with respect to your claim.

This phone call about 7-10 days after the initial letter, is part of the process, they inform you that you should receive the ESA50 Questionnaire in about 14 days.

If you had received the phone call, you would have known that something was wrong when you did not receive the ESA50.

As far as I know they do not withhold the number, I have seen several numbers that they call from,

If they rang you ask them what number would have come up.

This could help you in fighting the situation.

Thanks for those numbers

I have searched my truecall call log and none of those numbers come up.

This means no calls from those numbers I do have several calls which are from wirthheld or unavailable numbers were the callers hang up and looks like this:

15/06/2011 23:24 Incoming Unrecognised Caller - Hung up at Shield 00:00:05 WITHHELD

17/06/2011 17:40 Incoming Unrecognised caller - wrong breakthrough key 00:00:32 UNAVAILABLE

Basicly any call without a caller ID is screened by truecall. It plays them a recorded message asking them if they are a family, friend or invited caller to press a key if not hang up and dont call again.....If they dont press the right key then the call is eneded.

The DWP have phoned me loads of time about IB and IS they always manage to get through ... so why not ESA?
