Hi all,

on Friday I had to drive to Bridgnorth (3 hrs each way) to take my children to their fathers funeral. As you can imagine, it was a very emotional day.

We got home just after 10pm and guess what was waiting for me? My new ESA50!

Anyway, my question is, if it's due in on 19th Sept and I pay for next day delivery, what date, at the latest, can I risk sending it?

Hi Fedup,

Great timing by the DWP, !!!.

It's a hard one to advise on, I am sure you have read the "recorded delivery" thread above.

It seems that the ATOS address can either be a PO Box number, or the actual building.

I intend to post mine by Recorded Next Day Delivery, about a week before deadline.

I will probably back this up with an E-Mail to ATOS, and another recorded delivery letter to the DM, bit of an "overkill" but what can we do?.

Thanks bro, like you say, great timing!

Have read the thread on recorded delivery. I will keep reading for experiences on here over the next few weeks.

What you intend to do sounds sensible so will keep that in mind.

Hi Rachel,

I'm sorry for your loss, this must be a very hard time to cope with without the additional stress of completing an ESA50.

If you are finding it impossible to deal with then you could consider asking for an extension on the deadline for return, though clearly there are no guarantees it would be granted.

If your form is due back on 19th and you send it guaranteed next day delivery then I can't see any reason why you shouldn't send it say on 17th, so long as you have proof of the method of posting. You will have taken very reasonable steps to ensure that you met the deadline- you can't be held responsible for failures by the post office.

This is just my opinion, however, I don't have any statute or case law to support it. And, whatever you do, please try to make a copy just in case it does go astray.

Hi Steve, thankyou for your reply.

Not being able to make phonecalls or draw attention to myself, I will probably stick with the given dead line.

However, will do some internet research into the post office and liability.

recorded delivery is not always there next day and the 19th is monday to get there for the 19th and be sure its there by 19th you would need to send it special delivery next day by one posted on thursday the 15th september cost about £7 depending on the weight of added reports :)
