Hi i receive a war pension at 80% i also get wp motobility at higher rate & constant attendance allowenc at the full day rate i aslo get comforts allow at the lower rate & incapacity bennifit but have been told to put in for the unemployability supplement of the war pennsins whitch meens i will loose my incapacidy allowence but will i still have to be reasest for esa

Normally we do not deal with War Pensions in the forum, but one of our Moderators Pete is conversant with WP so he may be able to deal with your enquiry?

Pete is currently recovering from illness and is gradually easing his way back into moderating duties, but I am sure that if he sees your post he will reply in due course. In the meantime however, there are a couple of our existing members who are WP recipients who may be able to assist with your enquiry?

you need expert advise its a minefield call the British Legion

Below is my understanding of it after I spoke to The MOD War Pensions DWP and my MP

under the new rules for Unsupp if you get it you cant have ESA too see below

if i was getting wp today under new rules i would go for unsupp as once you have it no more medicals where as esa is as and when they feel like testing you.


i have ib and unsupp under old rules so when i move to esa I might get both but not holding my breath. :laugh:

Hi,

Having got the latest update from Norcross, it would most certainly be wise to obtain face to face advice regarding opting to to claim Unsupp in lieu of ESA.

However an Unsupp award can be and is reviewed from time to time. These reviews can be medical or financial or both. In some cases you may not be aware you have been reviewed.

There are some queries still unanswered with the implementation of ESA and it's relationship with Unsupp though. Queries such as, for example, the situation if one loses ones Unsupp and then tries to reclaim Contribution Based ESA (usually a 60% War Pension would negate claiming Income Related ESA in a lot of cases) and whether the ESA claim would/would not succeed.

Until this sort of issue is resolved either by legislation or Upper Tier tribunal ruling things can be and are to a degree uncertain.

Hi all, I am in the same boat. WPUMSUPP and contributions based Incapacity Benefit, the ICB is due a review in Jan 2012, 13 months before my 60th B'day. My Umsupp is due for review in 2017 12 months before my 65th B'day. Still wondering just to stop the ICB as it is only £113 per month and a lot of hassle.

I to an 80% with WPMS.

review dates for unsupp and other allowances are now on the computer and if you call the helpline they can tell you the dates

I found out by accident I was re doing overage child allowance for the youngest.. and checking if it had been done called helpline and was told yes and given a strange date which did not tie in with other dates given in the past and was told "ahh thats unsupp"
