I receive Income Support but DWP insist it's incapacity benefit with national insurance credits as I have not paid enough NI.

Income Support is on all letters about payment etc along with a disability premium for my long term mental health issues.

Looked at p41 as you suggested and I'm even more confused than ever. Hope CAB can help when I see them.

Had meeting with CAB welfare supervisor on Monday. After looking at the medical report from my hospital consultant he was of the opinion that my appeal would not progress to full appeal and would lapse.

Even so I will try and keep an open mind and wait to see what the DWP do after they see all respective documents.

He did confirm that during ESA appeal process any previous premiums received allied to income support do not carry over to esa assessment rate. Therefore in my case I am going to lose £57 a month. I understand many other people are in the same boat but it's downright criminal!!

Look at the link below if people have not already seen the DWP response to a Freedom of Information request from October 2010. It's about mental health qualifications etc. Look at the selected paragraph at the very bottom of the page.

Update:

With help from CAB representative I sent ESA appeal form/GP sick note and medical report from doctor at hospital. The latter two were requested by dwp by phone when they contacted me on 8/8/'11 to tell me no points from esa medical.

As you guys advised sent appeal form etc etc by special delivery on 22nd August and they arrived afternoon of the 23rd August.Took copies as well.

Got letter from DWP Saturday morning the 27th August, I need to supply a GP sick note.

Reluctantly after 7 attempts to get past automated messages, just been told today got the appeal form but original GP sick note and letter from hospital still not received.

Local DWP on my doorstep but all paperwork related to appeal etc says send it to office more than 80 miles away from me.

DWP guy who just told me no sick note etc etc, hinted the benefit delivery centre many miles away from me where I have to send stuff is only a postal sorting office. Then everything is processed and eventually delivered to DWP office dealing with appeal etc.

7 days on. Ok bank holiday been and gone but DWP putting onus on me now because of their incompetence.

The whole process of this ESA appeal is making me extremely stressed and really anxious.
