my daughter mentioned in her esa50 about the exceptional circumstances as if found fit for work she would not be able to meet the jsa agreement as should would be unable to attend the "sigining on" and interviews so i hope this helps her case. she cant go anywhere on her own. if we have to appeal i will be using the descriptors and pints to say what i/we feel that she should have been awarded.

Would that fall under what has been termed 'the 3rd criteria'?

Hi I posted a thread regarding this but not appeared yet. Can you get a written statement from a GP or consultant with words to this effect? I have managed to get one and was querying whether to send with the form as the letter from ATOS is confusing re this issue. I intend to send the letter from my consultant with my form ESA50 but letter from ATOS states do not send medical statements with your questionnaire but to send them to JCP!! Very confusing.
I think a letter from a medical professional stating the exceptional circumstances may help. Will let you know what happens when I send in mine.
Good luck!

Hi mon24

I think the letter is referring to medical certificates (sick note fit note!) as these need to be sent to the DWP.

Page 20 of the form has a box to tick to say that you are sending medical reports.

Regards

Derek

Thanks for that didn't notice it have just looked and seen it now. Will post how I get on re the letter stating exceptional circumstances! Had hoped that the letter would mean not having to fill the form in as my problems are physical and the pain and stiffness caused by sitting down and filling in the form In alone is enough of a problem! Am taking my full six weeks for this reason as am doing it in bite size chunks but have already had the reminder letters and the phone calls !!
Many thanks
