Hi,

Although the exact process isn't yet known, it is believed that once your year of WRAG (Contributory) expires, you will be tested to see if you qualify for 'Income Related ESA'. If you qualify this would then start into payment.

If you don't qualify for Income Related ESA due to other income or savings etc, your payments would stop. However it could be worth continuing to claim it (without actual payment) to make sure National Insurance Credits are paid and also so if your condition deteriorates to Support Group level in the future you may still qualify for payment.

If one doesn't bother to continue the claim (without payment) it may be that one would have to fully re-satisfy the NI contribution rules (by working and paying NI) to reclaim Contributory ESA (Support Group) in the future.

That is as we see it. however it could change as legislation and operating practice develop.

Hi
I read it the same as Pete.
I am also in the WRAG, and my case is due for renewal in May2012,shortly before my money would be stopped if the 1 year rule is passed.
However i am not sitting back and waiting for it to happen,i have made my MP aware of this ridiculous idea, and i urge everyone who is placed in this group to contact their MP and let them know how this is going to affect them financially, put pressure on them to get it changed.

I think I have brain fog today! What do you mean by continuing to claim it? I know that I wouldn't qualify for the Income Related ESA and don't care about the money. However, I really care about my N.I. not being paid as that affects my future so much.

As Pete said in his post, even if you fail the ESA(IR) means test you retain an underlying entitlement to the benefit.

In this case, you will continue to receive NI credits towards your State Pension, however, you may have to complete additional ESA50 and potentially attend medicals, in order for you to continue to receive it.

Hope this explains it.
