I agree. DLA is a seperate benefit, paid to those who meet the criteria whether or not they are in work. The fact that the CESA has stopped shouldn't make any difference.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

I am guessing that two scenarios are being confused here.

When someone is migrated to ESA, there is initially a paper assessment and if the Decision Maker at the DWP considers it necessary, Atos carries out an assessment. Information gathered during that assessment can be used in considering/reconsidering entitlement to DLA.

However, when the contributory ESA stops on the basis of the 12 month time limit, there will not be a medical (except where there has been some sort of appeal in relation to what group the claimant is in, which is a separate issue) and therefore the ending of the ESA will not trigger a reassessment of the DLA.

If you stop getting ESA after 12 months and then you decide that you are well enough to do some work, when you start work, you will have to notify the DWP of this in relation to your DLA and it may be reviewed.
