Following on from the query previously and the percieved situation that claiments that are not able to receive payment for ESA (as they have gone past the 12 months contributary time limit been means tested and are not entitled to JSA) will have to remain in the system and go through medicals etc in order to be eligable for pensions etc through payment of NIC's does anyone know:
- will the claiment in this situation be required to undertake work related activity to be eligable to receive NICs and future 'benefits' and could NIC's be stopped as a penalty for not undertaking the WRA, attending interviews, accepting jobs etc????

Just to clarify, you want to understand a claimants responsibilities after having been on ESA(CB) for 12 months, while in the WRAG.

Even if you don't receive any payments due to assets, income, or your partner working, as I understand it you will still have an underlying entitlement to ESA(IR) and will therefore continue to receive credits towards your State Pension.

However, to retain the entitlement you will need pass any further assessments, and it is possible, that you will be referred for Work Related Activity.

According to the Decision Makers Guide, sanctions can only be applied to the payable benefit, so on the assumption that nothing is payable in the first place, there appears to be no further penalty that can be applied.

Hi, from what I have previously read, you will not have to go to WFI's but can ask to if you feel like it!

Thanks for the replies it is little comfort if my husband looses all but as he agrees crucial that he is at least paying in his subs. Gordon - ta you have reassured us.
