does non dependant pay rent when i am on mid DLA?

Hi,
I now recieve mid rate care DLA and wrag ESA, my son who works and is classed as a non-dependant pays a % of the rent for our council home and council tax. Thanks to the DLA adviser at the jobcentre i found out that apprently because i am in reciept of middle rate care componant that my son should not be paying any % of rent at all, has anyone else heard of this? i am a bit wary as to if this is correct as the jobcentre staff have often given me conflicting information i cant seem to find anything information about it.

Are you in receipt of Housing Benefit and/or Council Tax Benefit?

This is not something we advise on on this site, however, where I live a full-time carer on Carer's Allowance can claim a class U examption. Check out your local authority's website or council tax team. Your son would be able to claim carer's allowance if he is providing at least 35 hours a week care. You should get face-to-face advice on the impact of your own benefits of his doing this.

thanks for your quick respones. i get HB and CTB my son works 35 hours a week, my daughter who lives close to me does the main part of caring with my son and other members of my family filling in when and where she is unable/having a break.

It appears that what the DWP are telling you is that because you are now receiving the care component of DLA, there will not be any deduction from both your HB and CTB as a result of a non-dependant living in the household.

Even if you have a non-dependant living with you, no non-dependant deduction is made from HB and/or CTB for her/him, if either you (or your partner) receive the care component of disability living allowance (DLA). What this means is that if a non-dependant deduction was made before you received the care component, it will no longer apply and your amount of HB and CTB should be increased.

Does this fit with your circumstances and sound plausible?

Sorry for taking so long to reply,have had to try and sort out how much they owe me as their amount does not match mine (and i got my figures from their letter!!!).
YES you are correct my CTB/ HB non dependant rent deduction was done before i was in reciept of DLA.
thank-you for your asstistance,it has given great comfort to know someone cares.
