response from DLA after reconsideration request

Hi

I have recently requested that the decision maker who looked at my recent claim for DLA reconsider her decision regarding my allowance for personal care.

This was done on the advice of a welfare adviser at CAB, who suggested that an appeal would be too stressful for me and stress exacerbates two of my disabilities.

However, I have received what appears to be a standard letter from the DLA, not from the decision maker, and not signed by anyone,that is identical to the one I received from them when I initially requested that they look again at my claim in March, after completing the lengthy application forms.
The letter states that they have received a letter from me " about your request to look again at your claim" and goes on to say that it will take them 11 weeks to come to a decision.

I am rather confused as I have not asked for my claim to be looked at again, I have simply asked for the recent decision regarding my personal care allowance to be reconsidered. Am I correct in thinking there is a difference?

I am planning to send another letter highlighting this, enclosing my original letter in which I challenged the decision maker on several points, cross referencing statements contained on my original application form - thank goodness I photocopied the form. In my letter asking for the decision to be reconsidered, I also enclosed a sample day, after reading advice on this website.

Does anyone else have any experience with DLA reconsideration, if so is the letter I have received a standard response or have they mistakenly thought that I am asking for my entire claim to be looked at again.

Also, does any one know whether my payments will be affected during the reconsideration period, and how long reconsideration usually takes?

Hi Mon

If you asked for your claim to be reconsidered all components awarded will be looked at again. An award could be increased or its possible that it could be stopped altogether.

The letter you received is a standard acknowledgement letter, as the DWP DLA Decision maker hasn't yet made a decision.

As you have followed the advice of your welfare adviser at CAB, I would suggest you contact them again for specific advice. Otherwise you will find help in the orange section by clicking the Members Only section.

Just an update on the above.
I spoke with my welfare adviser, sent another letter along with medical evidence from my hospital consultant, and using advice from the guides on this site, was successful.
A big thank you for all the advice on this site, and to all members in a similar situation, it may be worth requesting copies of medical evidence from consultants under the data protect
act for a small admin fee as I feel that was very useful in my case.
