Tribunal adjourned hearing

Hi Everyone,I appealed against my DLA decision and it went to first tier tribunal.It was a paper hearing and the clerk of the court rang and asked me if i would agree for a Doctor to come to my home to prepare a medical report in relation to care and mobility. They require further evidence as they are unable to make a fair decision. Has anyone else had this happen? and if so what is likely to happen? I did think it was better than just being turned down and fairer for myself. Any views would be welcome

Looking positively, it means the panel are looking into your case and haven't dismissed it at the first hurdle.

Adjourning the tribunal pending a medical report is not unheard of and it can and does occur if the panel felt they did not have enough evidence in order to reach a correct decision on your entitlement.

Sadly as your appeal was 'on paper' the panel did not have the chance to ask you about your care and or mobility needs or even see you move/walk/mobilise etc which is one of the drawbacks of a paper hearing.

However your claim has not been dismissed so the panel obviously felt there was some worth in adjourning pending the medical.

It maybe worth reading the guides about DLA medicals in the members area to prepare you for the medical.
