ESA new claim was created by Karen
Hi after reading a post bro58 mentioned you can reapply for ESA after six months. Reason I am asking is that I failed the medical and had to claim JSA. I still do not feel well enough to work so was thinking I should be brave and try again. The health problems are the same as before depression and anxiety. JSA started in April 2011 so do I have to wait until October before I make another ESA claim?

When was the date of the adverse decision when you failed the ESA work capability assessment?

It was back in November 2010. From that date Nov until April I did not receive any benefit and had to keep applying for crisis loans. It was ony in April 2011 that I began receiving JSA. Iam scared of putting in a new claim just in case they stop my money again!

As over 26 weeks has elapsed since the date of the adverse decision, you can reclaim ESA immediately.

I am very sorry to hear you were found fit for work when you are clearly not and ended up living off crisis loans - did you not feel up to appealing the decision back then?
I would certainly apply for ESA if you feel you meet the criteria and appeal if found fit for work again.
Your case certainly illustrates that being found 'fit for work' is no cure for anxiety and depression.
It is appalling that the bar has been raised and the whole process deeply flawed.
I really feel for you.
