I have appealed being in WRAG as I believe I should be in Support.

I have been told not to expect a hearing until January 2012.

My appeal is based on physical and mental health grounds and I am relying on factual evidence supplied by my GP for my DLA claim as the GP's report clearly states that I suffer from constant difficulties, I cannot walk more than 20 feet without discomfort or difficulty and that I am suffering from pervasive exhaustion that precludes me from functioning normally on a daily basis.

The mental health side of things has also been reported and further evidence is being provided by my CPN.

Whilst you are waiting for your appeal,have they cut your benefits? I have read that they do this.

As a person in the WRAG has successfully qualified for ESA, when they appeal to be placed in the Support Group, they will continue to receive the WRAG rate while waiting for a hearing.

I know the situation may not arise, but what would happen if placed in WRAG on cESA and you appeal the decision, and your appeal is not heard within the 12 months period of contribution based ESA, would DWP be obliged to carrying paying the benefit beyond 12 months?

Maybe an unlikely scenario, but as it seems DWP are migrating IB recipients onto ESA without carrying out a medical, I can only see the appeal facility getting further behind with the sheer volume of appeals that will have to be heard. We can only hope the entire system grids to a halt, and then finally maybe somebody will take notice of the appalling way in which disabled people are being treated.

I can only dream!
