I'm sorry Martin, but you are asking me to comment on two documents, neither of which I have had any sight of, which discuss your conditions, which I have no knowledge of, other than what you have written in the forum.can i ask u based on the points iv stated above do u agree that the evidence on the ESA85A form seems contradictory?
& the fact that it looks like its entirely based on the 113 form is unfair? (there is no mention of the ESA50 form i filled in & they did not get a report from my psychiatrist only my gp)
there is also no mention of my physical health (me/cfs), only my mental health.
thanks again for any advice given folks

If you believe that important information from your ESA50 has not been included in the decison making process then you should hilight this in any submission you choose to make.
Beyond that, I don't believe I can help any further.

i understand that u have not seen the documents. exactly that, i assumed that u could comment with ur experiance based on what i have written in the forum only. just as other moderators & members comment on what other members have written in the forum only. r we not assuming that what members write is the truth, without seeing any of their documents?
i was also hopeing that other members would read my posts & share their own thoughts & experiances with me. the post was not aimed specifically to urself Gordon but i appreciate ur advice anyway.

thanks for ur reply, i agree with u on 1 hand & then on another i think the fact that they have based their decision for me on the 113 form compared to other peoples reports being based on tea leaves is not something we should b grateful for, it just goes 2 show how bad these decision makeres r.
i think we r all kind of feeling just now that we should just count ourselves lucky 2 have gotten ESA in the first place & not rock the boat by appealing when they have not considered all the evidence or done their jobs properly. unfortunately far too many of us will just lie down & take this.
its such a bad/scary time for disabled people just now.

Sometimes it's possible to comment on what a poster says without seeing the relevant documents, and sometimes it isn't. I'm sure you appreciate that it is very easy to give incorrect information or misleading opinions that would not be given with sight of the documents.
I will just say that where the ESA85A mentions 'claimed level of disability', I would presume that this refers to your disability claimed on the ESA50.

this means that i could argue that the claimed level of disability maybe consistent with the ESA113 form but is not consistent with the evidence on the ESA50 as on this form i was claiming for me/cfs also. i wont know exactly until i get a copy of the ESA113 which im finding hard 2 obtain. the DWP say that its an Atos form & Atos r saying they have nothing 2 do with it once its passed onto DWP. frustrating!

You usually have to put the request in writting to the surgery's admin person.
