Adding A partner to esa claim was created by helchis
My partner has just lost their job,we have been told you cant claim two benfits in the same house hold,so as im esa contribution based (in support group)we was told to add my wife to my claim,the problem is we have been told different things,one advisor said my contribution based esa will be toped up with income related pay if there was more to be paid,and when my partner got a job i would go back to just contribution based,another advisor said it will be changed to a all income related and if my partner got a job i will lose my benefit,can anyone advise please,also will this trigger a new medical

The rules are actually quite simple, it's the implementation that is complicated :)

You can both claim a Contribution Based Benefit as individuals; so you can claim ESA(CB) and your partner could claim JSA(CB) (assuming eligibility).

If your partner is unable to claim a contribution based benefit then they can claim an income related one, however, this can only be done as a joint claim. This is where it gets complicated; you could continue with your ESA(CB) but it will be counted as income and will be deducted from your partners income related claim.

The bottom line is that you need to get advice from the CAB or Welfare Rights, where they can sit down with you and go over various scenarios, which of course we cannot do on the forum.

Thanks Goedon but can i add her to my claim on contribution based esa, and it gets topped up with income related,or does my whole esa claim go to income related
