Legal was created by chrissy v
Hi to any Mods, just a question really, i,m curious about the fact that some people are migrated to ESA whichever group without having to attend a medical assessment, and good luck to them, i,m just curious as to weather those people who do end up having a medical have any legal grounds about the fairness of the system that some people don,t have a medical. Is it a point of law that the system be fair to all, and no i,m not having a dig at those people who don,t have an assessment, i,m just trying to make a point.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

A medical assessment of ALL claimants is made prior to a Decision being made on their claim. In some cases, ATOS are able to do this based on the informations supplied to them as part of the assessment, in other they are not, and a medical is scheduled.Hi to any Mods, just a question really, i,m curious about the fact that some people are migrated to ESA whichever group without having to attend a medical assessment, and good luck to them, i,m just curious as to weather those people who do end up having a medical have any legal grounds about the fairness of the system that some people don,t have a medical.
