The DWP is to get the power to arrest claimants, search premises and seize evidence as well as being able to fine claimants where they do not have enough evidence to bring a criminal case for fraud, the government has announced.

The new measures, many of which will not be possible to introduce without an Act of Parliament, are aimed primarily at cutting fraud in Universal credit (UC).

In total, the DWP are to spend £200 million a year on the new initiative, which will see 1,400 more staff in frontline counter-fraud teams plus a new 2,000 strong team solely for checking universal credit claims.

The sweeping new powers will mean that designated DWP staff will be able to arrest claimants, search premises and seize any evidence they find without needing to use the police. The DWP say this will put them on a par with HMRC and the Gangmasters and Labour Abuse Authority (GLAA).

There will also be new powers for the DWP to force other organisations, especially banks, to provide data about claimants on a much wider scale than is currently legally allowed.

At the moment the DWP can only require organisations to give them information about named individuals where there is already a suspicion of fraud.  The DWP want much broader powers to access information.

They say that a “small test” has been run with a bank to assess the potential of using a feed of banking data to identify possible fraud and error, “with very encouraging results”.

The DWP will be able to impose civil penalties on claimants based on a percentage of any overpayment, where the DWP does not have enough evidence to prosecute. This will be in addition to having to repay the whole amount of the benefit the DWP consider to have been fraudulently obtained.

The DWP already have the power to impose civil penalties, but they have to have evidence sufficient to meet the standard for criminal prosecution before they can do so.  Under the new proposals, a lower level of evidence would be needed in order for the department to impose a penalty.

The DWP will also be able to impose penalties on organisations which the it considers are “promoting benefit fraud schemes online, creators and sellers of fraud toolkits on social media or someone supplying fake ID.”

    This is another shove in the push towards authoritarian rule, in the same stable as the new laws and powers against protest and refugees. It must be opposed by everyone, even the blindly loyal MPs should have a bit of love of country left to see this is wrong.

    I’m now in my sixties and have seen many things in my lifetime but this is on par with living in Russia. We are one of the most watched and follow countries on earth and yet the government want more but not for the well off, they can afford to hideaway everything they make. Just hit the poor again and again. We are dispensable. If I had the strength and the means to do so I would take my family and myself and run as far away from this rotten country as I could. Why anyone wants to come here is beyond me, oh unless you have plenty and want to steal more.

      And what will happen when they have people in the DWP abusing their positions with illusions of grandeur and starting to act like they are the law
      I can give you a good example I was honest and told them when I had over the 16,000 and they did nothing but hound and harass me and made me live off that money until there was very little left. They made me feel like I had done something 
      I am a 57 yr old Disabled lady that lives alone. Not nice

      I also had a very unpleasant neighbour that reported me twice
      The fraud guy said he believed me and would have my benefits re-instated but when I rang up to see why it hadn’t been done I was told he didn’t have the power to do that (illusions of grandeur) 
      They made my life a misery for nearly a year

    How long before DWP abuse their powers?
     If experience with the police is anything to go by, usually about a week.

    Meanwhile £4.3 Billion debt wiped off by Government for Covid fraud… which doesn’t include the £billions spent on the unusable PPE contracts….. does make you wonder if the poor/ disabled are being needlessly persecuted….

      @Angel Think of an egg timer; you can pick it up and put it down and turn it around. That is how the system works when they see something that benefits THEM not us. They do an about turn and then the focus is diverted. So what doesn't benefit US benefits THEM! Irrelevant of how hard people have it. What suits THEM is what is important to THEM! Like if you have shares in energy companies then it does good to hike up energy prices so they get fatter profits! To hell with US in a handcart if we can't turn the heating on!

    What will their next master stroke be !!!!

    Is this a ploy to target all disabled / sick / ill claimants, albeit the true, real blame for this fiasco lies 1st hand with the DWP & goverment for allowing fraud on such a scale during the pandemic period to happen in the first place.

    I would have half expected immediate sackings to be distributed amongst civil servants who allowed this to happen, and also the under and ministers should resign for total incompetence.

    But once again these fraudulent billions will which they unbelievably kept dishing out to fraudsters and criminal gangs, will undoubtedly be clawed back at the disabled claimants expense.

    (why has there not been any arrests for these fraudulent UC benefit pandemic claims)
    (whatever happened to the dwp checking out these UC claims before letting their cash cows spew out tons of public money)

    (why isn't the government going after the fraudsters,  why put the emphasis of this fraud onto the disabled.  As it seems to be that way to me, or have i got it all wrong??)


    This is or may also be used as another governmental campaign / scheme to turn joe public once again, against disabled people on benefits in the UK.  This has been happening for many years now, so why should this not be another DWP/government master stroke  to tarnish us all with the same brush.

    Well roll on the next general and hopefully the public will vote the nasty party out.

    Always the vulnerable have to keep suffering by the hands of this self-serving government.

      look at the miners in the 80's and the torries are still the worst as ever.and going off topic a minute who sold of gas,
      electricity,bt etc yeh you have it the torries.
      what do we need to do to get rid of them for good !!

    Reminds me of years ago when the local ‘stasi’ from the council used to come around all dressed in black, in pairs, even had shades on, to check your entitlement to housing benefit, or that you were not subletting in your council property.
    No notice, just turned up and bang at your door, terrifying. Made you feel like you were a criminal just for breathing the air itself.
