can i get esa

hi,
im on income related esa and health assessment advisory service sent letter for me to attend for an assessment. i got told by dwp when i phone its to do with the letter i sent in july,14 and esa50 (atos) to be placed in support group.health assessment advisory service did not send new esa50, i got new esa113 from doctors and sent both to health assessment advisory service and dwp

Hi lm,

Being in receipt of Income Related (IR) ESA or Contributions Based (CB) ESA is nothing to do with which ESA group that you are in. (WRAG or Support Group. (SG) )

From what you state, it looks very much like you requested a review to gain entry to the SG last year, and you now have to attend an ESA F2F ("medical") with CHDA (Maximus) as part of the review that you requested last year.

Therefore, my previous comments regarding you having to attend an ESA F2F "medical" are relevant.

ive got esa(ir) medical tomorrow to see if i can get in the support group from the discriptors(got 15 points last time round) ive sent esa113 from doctors,latest medical xrays,up to date esa50.(dwp told me i dont need this lol). condition has changed alot.
My question is, do i still get assessment rate if i go for mandatory reconsideration and appeal.

Hi lgm,

If you request a Mandatory Reconsideration (MR) of a fit for work decision, you will not be paid ESA Assessment Rate whilst the MR is ongoing.

You will have the option of claiming JSA with reduced conditionality in the MR stage to gain some income.

If the MR is unsuccessful, and you move forward to an appeal to The Tribunal Service (TS) you can then revert back to Assessment Rate ESA once the TS have accepted your appeal.

If you are placed into The WRAG, and request an MR to gain access to The SG, payment of WRAG ESA will continue whilst the MR process and any subsequent appeal is ongoing.

at the moment im in the(ir)wrg, have been for just under 18 months, now called for a medical, does this make any difference as i sent letter year ago stating i should be in sg

Hi lgm,

Although unlikely if your medical conditions have deteriorated, and you requested a review/super session to be placed in The SG from The WRAG the information provided in my previous post would still apply if your were found fit for work or remained in the WRAG.

If you are placed into the SG, the SG decision should be backdated to the date that you initially made the written request for the review/supersession.
