My daughter's PIP has been declined. She felt that the medical assessment was rushed and the nurse has not recorded that she has attended both private and NHS counselling sessions prior to the PIP application, simply writing 'No specialist input'. We attended the appeal tribunal today, but our 'representative' presented psychiatric reports at the start of the tribunal and the judge said they were unable to accept them as one of the panel was blind. We asked for and were given an adjournment. However. the judge did mention that the psychiatric reports only covered the time from December and no evidence had been offered from the original application date in August.
Is it simply a matter of our providing previous conselling dates from prior to August ? Should we supply these dates prior to the new appeal tribunal or will it suffice to provide them on the day ?

Hi Peter,

What a long, drawn out process this is! :(

I have not heard of this happening before for this reason - but there is no reason why one of the panel should not be visually impaired I guess!

The issue will be that the tribunal can only consider the situation as it was when the original decision was made. If you can provide something that ties in the psychiatric report with your daughter's condition in August, that will be very helpful. If there is time to submit it in advance it would be a good idea, otherwise you will have to present it on the day - and hope you do not get the same panel member again.

Was hoping that the dates of the counselling sessions which predate the application will do. Will that be the case, you think ?
Talking about drawn out, this is effectively the third postponement !

Hi P

Any evidence that can be tied in to the date of the adverse decision appealed, and support the fact that she suffered from her stated limitations at that time should be taken into account and should help !

It is always advisable to submit any fresh evidence to The Tribunal for their consideration 7-10 days before the hearing date.

Although you can submit a page or two on the day, by providing 4 copies of everything to The Clerk on arrival.

Anything more than a page or so on the day may result in the evidence not being taken into account and/or the Hearing being adjourned !!
