I have also received a letter from DWP saying they've applied for a statement of reasons from HMCTS. I am due back pay for three months. In your experience do many of these find an error in law or is this just a delaying tactic by the DWP?
Thank you.
It's most certainly not a delaying tactic by the DWP although I can understand why it might seem that way.
Unfortunately we do not see enough UTT appeals to drawn any real conclusions on how often an Error is believed to have happened, even if the DWP thinks that there has been one there are potentially three levels of dispute as to whether this is the case or not.
The first will be when they and you have received a copy of the SoR, I am afraid this could take several months.
